Whether served with divorce papers or serving them, the decision can be wrought with anxiety, anger, sadness, confusion, and fear.  Fortunately, the process can be relatively straight-forward and these days, many people choose to avoid the costs and time-suck of the court process by handling all the filing and paperwork themselves. The First Judicial District Court has made the process easier by providing all of the necessary documents online with instructions.  However, it can be helpful and comforting to have an attorney walk you through the process and offer counsel on whether this approach is right for you. While I am not currently taking clients with hotly-contested cases, I am happy to assist with reviewing DIY divorce filings and offering insights into how you can handle your divorce in the fastest, most efficient way. Court can be a last resort when the spouses are motivated to save time and money, and limit the stress on their family.    


Guardian ad Litem

When an adult is unable to care for themselves physically, mentally, and/or financially, they may require another person to be appointed as their Guardian and/or Conservator.  In the simplest terms, a Guardian is someone who ensures that the Ward is cared for physically and mentally, and ultimately watches out for the Ward’s best interest; a Conservator manages the Ward’s finances. Often, the Guardian and Conservator are the same person (or persons).  In New Mexico, when a Petition for Guardianship is filed (by the person seeking to become the Guardian/Conservator), the Court appoints a “Guardian ad Litem” to represent and protect the Ward’s interests during the court process.
